vRide terms and conditions
1.1 ‘JDRF’ means Juvenile Diabetes Research Foundation, charity registered in England and Wales (Registered Number: 295716) and in Scotland (Registered Number: SC040123).
1.2 ‘Entrant’ means a properly registered person applying to take part in the Event and who agrees to these terms and conditions.
1.3 The ‘Event’ means vRide, the virtual cycle challenge taking place between 1 October 2017 and 31 October 2017.
2. Age of Entrants and registration
2.1 Entrants must be aged 16 and over to register.
2.2 Each Entrant must complete and submit a registration form (a “Registration Form”) whether participating as an individual or in a team. By submitting a Registration Form, the Entrant agrees to be bound by the Terms and Conditions.
3. Health and fitness
3.1 By submitting a Registration Form the Entrant agrees that, as far as they are aware, they are sufficiently fit and physically able to take part in the Event and, to the extent that it may be necessary, they have sought and relied upon any medical advice before the Event. It is each Entrant’s responsibility to assess their fitness and to ensure that they participate only if sufficiently fit. Should any medical or physical condition arise prior to the Event which is likely to affect the Entrant’s ability to take part in the Event, the Entrant should withdraw from the Event.
3.2 The Entrant understands and has considered and evaluated the nature, scope and extent of the risks involved, and has voluntarily and freely chosen to participate in the Event entirely at his or her own risk.
3.3 The Entrant acknowledges that participation in the Event involves physical activities and inherent risks and dangers of accidents, personal and bodily injury (including death) and property loss or damage. If you have any medical conditions that could be adversely affected by exercise, or if you are in any doubt about your health, you must get clearance from your doctor before participating.
3.4 JDRF understands that Entrants who have type 1 diabetes are keen to support JDRF and many are fit enough to take part in our Events. However, Entrants who have any doubt about their health or have a medical condition that could be affected by exercise, must obtain their doctor’s approval before participating in any Event.
4. Safety and insurance
4.1 JDRF does not provide any insurance, whether life or medical or liability, for any illness, accident, injury, death, loss or damage that may arise in connection to the Event. Entrants shall be responsible for arranging their own suitable and adequate insurance protection to cover their participation in the Event, including without limitation cover:
(A) for material loss/damage to any equipment they may use in the Event or personal property (including clothing);
(B) any loss or damage they may cause to a third party;
(D) negligence of any party.
4.2 All Entrants taking part in the Event must:
(A) wear a cycle helmet when cycling outside;
(B) ensure that their bicycles are in a roadworthy condition;
(C) observe the rules of the Highway Code;
(D) ensure that any bicycle used during the Event complies in all respects with all relevant and applicable legislation; and
(E) not carry children on their bicycle, or in a child seat, trailer or similar device.
5.1 Participation in the Event is at Entrants’ own risk. Entrants irrevocably agree to hold harmless, indemnify and reimburse JDRF from and for any liability, sum, costs, damages or expenses (including legal and professional fees) incurred by JDRF in connection with any accident, loss, damage or injury (including death) arising out of attendance at and participation in the Event or any part thereof (except where any such injury or death is caused by the negligence of JDRF or any of its employees).
5.2 Under no circumstances shall JDRF be liable to Entrants in contract, tort (including negligence) or otherwise for any loss of business, revenue or profits, charity funds, anticipated savings or wasted expenditure, or any indirect or consequential loss or damage whatsoever (notwithstanding that such loss was within the contemplation of the parties at the date of submitting the Registration Form) arising out of an Entrant taking part in the Event or any other matter arising under these terms and conditions.
5.3 Nothing in these terms and conditions shall exclude or limit the liability of JDRF:
(A) for death or personal injury caused by JDRF’s negligence;
(B) for fraud or fraudulent misrepresentation; or
(C) for any matter which it would be illegal for JDRF to exclude or attempt to exclude liability.
5.4 JDRF will not be liable for any actions of any spectators or other third parties.
6. Data protection
6.1 By entering into this agreement, Entrants agree that any personal information provided by them or collected about them in connection with the Event may be held and used by JDRF in relation to the Event and its promotion.
6.2 At all times JDRF shall treat Entrants’ data in accordance with relevant data protection legislation.
6.3 Entrants agree to inform JDRF of any changes to the information supplied in their original application as soon as such changes occur.
7. Acceptance of the Terms and Conditions
7.1 By registering to participate in the Event, an Entrant agrees to be bound by these terms and conditions.
7.2 These terms and conditions (and the documents referred to in them) constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the Event. The Entrant acknowledges and agrees that by registering to participate in the Event he/she does not rely on, and shall have no remedy in respect of, any statement, representation, warranty, understanding, promise or assurance (whether negligently or innocently made) of any person other than as expressly set out in these terms and conditions.
7.3 If any provision in these terms and conditions, whether in full or in part, is held to be invalid or unenforceable, all other remaining provisions (in full or in part) shall continue to be valid and enforceable.
7.4 These Terms and Conditions and any dispute or claim that arises out of or in connection with them is governed by and construed in accordance with English law. The English courts have exclusive jurisdiction to settle any dispute or claim that may arise out of or in connection with these Terms and Conditions.
